Two leading athletic shoe companies are running to a federal court in Virginia to decide on a latest patent dispute in an ever-growing list of litigation.

On Tuesday, counsel with Finnegan, Henderson, Farabow, Garrett & Dunner filed a declaratory judgement action in U.S. District Court for the Eastern District of Virginia on behalf of Brooks Sports against the German-based footwear company, PUMA. Brooks, which is headquartered in Seattle, seeks declaratory judgment in a patent dispute over its product line of running shoes called Glycerin 21. The case is captioned Brooks Sports v. PUMA.
