A Colorado technology company cannot proceed with a legal-malpractice suit against a boutique Boston law firm involved in an underlying wireless technology patent dispute, finding the allegations to be time-barred, a federal judge held last week.

BlueRadios, based in Castle Rock, Colorado, accused the Boston law firm Hamilton, Brook, Smith & Reynolds of engaging in legal malpractice, fraudulent concealment, breach of fiduciary duty and aiding and abetting. BlueRadios claimed the law firm developed a plan to misappropriate its Golden-i technology and grant patent ownership to its former business partner Kopin, a Massachusetts-based company with expertise in designing and manufacturing microdisplay technology, according to an opinion filed Sept. 18 in BlueRadios v. Hamilton, Brooks, Smith & Reynolds.
