The Missouri Court of Appeals this week affirmed a prejudgment interest award of over $4 million to the widow of a man who was killed in a car accident, concluding the plaintiff had adequately served the defendant's counsel her settlement offer.

Following a $40 million jury verdict in the plaintiff's favor, Missouri Court of Appeals Judge Edward R. Ardini affirmed the prejudgment interest award of $4.36 million to Jill Mabie, who filed a wrongful death suit on behalf of her husband Charles Mabie, who was struck and killed by Somona Mason, who was operating a vehicle with phencyclidine, or PCP, in her system.
