An Illinois appellate court rejected a hospital's request to transfer a medical malpractice suit from Chicago, after concluding the majority of case factors did not weigh in favor of a new location.

In a Tuesday decision, Illinois' First District Appellate Court rejected defendant Adventist Bolingbrook Hospital's request to transfer a case from Cook County to Will County, where the plaintiff and individual defendants live. In considering both private and public factors, the court concluded the defendants failed to establish that an alternative forum, in this case Will County, was favored over Cook County, where the trial is scheduled to take place.
