A state appeals court overturned an over $405,000 judgment against a Chicago restaurant for unpaid rent because a trial court proceeded with a trial despite their counsel's health issues that left him unable to participate.

The Appellate Court of Illinois First District issued an opinion Oct. 30, finding the Cook County Circuit Court abused its discretion when it left a tenant restaurant, Onward MSO, without trial counsel in a rent dispute brought by the University of Loyola Chicago. Onward was represented by attorney Richard Carbonara of Carbonara Law in Schaumburg, Illinois, who withdrew from the case after a motion for continuance to accommodate his health issues was denied.
