The Missouri Supreme Court reversed a ruling in favor of an insurance company, concluding the plaintiff established a breach of contract claim after the company didn't pay her sales tax and fees incurred in the process of replacing her damaged vehicle.

In a 4-3 decision, authored by Judge Robin Ransom, the majority reversed a Jackson County Circuit Court decision granting Shelter General Insurance Company's motion to dismiss Yolanda Bell's breach of contract suit. The suit stemmed from Bell's claims that under Shelter's automobile insurance policy, the company was required to pay for sales charges or fees on a replacement vehicle, even if she hadn't acquired a replacement vehicle and/or incurred any fees or charges.
