Everybody’s talking about litigation financing, from Congress to the courts, but could a requirement to disclose such contracts be around the corner?

Some states and judges already require some form of litigation funding disclosure, but, last month, a federal rulemaking committee decided to look at the issue. And, although previous federal legislation requiring disclosure failed to pass, a current bill in Congress could move forward given the increased prevalence of litigation financing and incoming Republican leadership in Washington, D.C.
