The U.S. Court of Appeals for the Eighth Circuit shot down a plaintiff’s medical-malpractice claims this week, finding she failed to provide admissible evidence that her purported nickel allergy in turn led to an allergic reaction to a titanium medical device.

In a Tuesday decision, the circuit court affirmed a summary judgment motion in favor of Dr. Ronald Richmond and Cape Girardeau Surgical Clinic, who were accused of negligence by plaintiff Renee Castaneda. Castaneda filed suit after she underwent an operation that involved implanting a titanium device that allegedly caused her to experience an intense allergic reaction. She claimed the defendants were negligent in implanting the device as she had informed them that she had a self-diagnosed nickel allergy. However, the record only included Castaneda's self diagnosis.
