The U.S. Court of Appeals for the Seventh Circuit reinstated a Fair and Accurate Credit Transaction Act suit against a military retailer to be sent to an Illinois state court after determining it was improperly dismissed in federal court.

In a Wednesday decision, the federal appeals court vacated a trial court's judgment dismissing plaintiff Linda Thompson's suit against the Army and Air Force Exchange Service, which provides goods and services at U.S. Army, Air Force, and Space Force installations. The three-judge panel concluded the U.S. District Court for the Southern District of Illinois erred in dismissing the suit for lack of jurisdiction as, in such circumstances, the federal removal provisions and the Fair and Accurate Credit Transaction Act instruct courts to remand cases to the state court. Judge Amy St. Eve authored the opinion and Judges Michael Y. Scudder and Candace Jackson-Akiwumi concurred.
