A class-action lawsuit against Dave's Killer Bread alleging deceptive practices in labeling and marketing of products is moving forward over allegations the company mislabels information about the amount protein contained in its products.
The plaintiffs, led by Megan Taylor, filed a lawsuit against Dave's Killer Bread for allegedly promoting its products as having high-quality protein on the front label. Dave's Killer Bread argued the plaintiffs' Illinois and New York consumer protection claims, among others, had to be dismissed as the front-label protein content were preempted federal laws and regulations.
