Addressing a circuit split over whether insurance solvency funds are considered a "primary plan," a federal judge in Chicago recently rejected an administrative judge's decision that required an entity to reimburse the federal government for a 26-year-old medical bill.

The Illinois Insurance Guaranty Fund, which protects policyholders and claimant members of insurance companies that go out of business, sought review of the administrative judge's decision in favor of the defendant, former U.S. Department of Health and Human Services Secretary Xavier Becerra.
