A consumer class action is moving forward against beauty products manufacturer and retailer Athena Cosmetics after a federal judge in Illinois determined the plaintiff's claims regarding the presence of a chemical ingredient in an eyelash serum were sufficiently alleged.

U.S. District Judge Andrea R. Wood of the Northern District of Illinois denied Athena's attempts to dismiss state consumer protection law claims and claims for fraud, breach of warranty, and unjust enrichment brought by the plaintiff Corrine Markoff. Markoff claimed the company failed to disclose that its eyelash serums contain dechloro dihydroxy difluoro ethylcloprostenolamide (DDDE), which can allegedly cause eye irritation. Athena argued Markoff failed to sufficiently plead her claims.
