Requena v. Otis Elevator Co.

Appellant sued an elevator company for negligence after he was hurt using an industrial freight elevator. All of the evidence establishes that the elevator functioned properly. Appellant's own expert testified that the elevator was both code-compliant and safe. Appellant failed to prove that the elevator company breached its duty to maintain the elevator in a condition of reasonable safety for use. Houston Court of Appeals, No. 01-08-00378-CV, 10-15-2009

OPINION

Appellant, Jose Hermilo Requena, sued Otis Elevator Company (“Otis”) for negligence after he was hurt using an industrial freight elevator. The trial court granted Otis’s motion for judgment notwithstanding the verdict after the jury returned a verdict in favor of Requena. Requena argues in his sole issue that the trial court erred in granting Otis’s motion for judgment notwithstanding the verdict.*fn1

We affirm.
