A Florida state appeals court has thrown out a $1.4 million jury verdict for a traffic collision because of “inflammatory and prejudicial comments” made in court by the plaintiffs attorney, who was berated by the same court two years ago for the same reason.

The 3rd District Court of Appeal excoriated Miami attorney Ronald M. Simon for “improper litigation tactics” in representing injured motorcyclist William Caiaffa as well as a nurse injured in a slip-and-fall accident outside Dadeland Mall in a case addressed by the court in 2008.
