Despite arguing that case law clearly required a legal malpractice case against Wolf Block to be stayed pending the outcome of the underlying suit at issue, a Philadelphia judge denied the defunct law firm’s preliminary objections in a one-paragraph order late last month.

Judge Allan Tereshko didn’t offer his reasoning for denying Wolf Block’s request to stay Potamkin v. Wolf Block pending the outcome of car dealership owner Alan Potamkin’s divorce litigation in Florida with wife Claudia Forman. Potamkin has sued Wolf Block and a number of former partners for allegedly drafting an ineffective prenuptial agreement that so far has not held up in the underlying litigation. Wolf Block argued Potamkin’s true damages against the firm can’t be known until the divorce action is final.
