An upstate appellate panel has thrown out the $44 million verdict awarded to a man paralyzed in a 1999 car accident, citing among other factors his attorney’s “misconduct.”
“In her summation, counsel for plaintiff improperly implied that [defendant] Ford Credit’s expert witnesses testified falsely for compensation; repeatedly alleged that Ford Credit engaged in a conspiracy to cover up the facts; and made numerous references to the resources that Ford Credit had as a large corporation,” the unanimous Appellate Division, Fourth Department, panel held in Smolinski v. Smolinski, 1155. “Further, plaintiff introduced extensive irrelevant and highly prejudicial evidence.”
