A Nassau Supreme Court justice stayed yesterday’s scheduled start of a trial against Long Island lawyer Thomas F. Liotti for allegedly defaming members of Garden City law firm Galasso, Langione & Botter. Justice John M. Galasso, who is no relation to the partner in the law firm, gave Galasso, Langione & Botter until March 14 to comply with a discovery motion by Mr. Liotti to advance his use of the affirmative defense of truth in the defamation action. An Appellate Division, Second Department, panel last week reinstated the defense of truth for Mr. Liotti regarding allegedly defamatory comments he made to a Newsday reporter in 2007 (NY Lawyer, Feb. 28).

At the time, Mr. Liotti was defending a man accused of embezzling about $2 million from the firm. Mr. Liotti told Newsday that partners at the firm knew his client was misusing funds and contended that the partners were doing the same thing. They then sued Mr. Liotti for $4 million for making those allegations.
