Circuit Judge Charles M. Greene decided a stay imposed in a federal class action against Miami-based Banner Supply is no longer in effect for Broward County homeowners who want to pursue their Chinese drywall claims in state court.
U.S. District Judge Eldon Fallon in New Orleans stayed all drywall litigation against Banner in state courts June 11 and followed up with orders Aug. 11 conditionally certifying Banner’s class and giving preliminary approval to a proposed $53 million settlement.
