SAN FRANCISCO — Steny Hoyer admits he was irrational. So does James Clyburn. The House of Representatives’ Democrats’ whip and assistant leader are among at least 13 congressional representatives who voted for the Defense of Marriage Act in 1996 but who joined an amicus curiae brief on Tuesday urging that it be declared unconstitutional.

DOMA “lacks a rational relationship to any legitimate federal purpose and accordingly is unconstitutional” states the brief, which is signed by Mayer Brown partner Miriam Nemetz of Washington, D.C.
