Bad faith lawsuits in auto accidents often the best last hope for catastrophic injury victims would essentially disappear in a House bill that was approved in committee, critics say.
A priority of the insurance lobby, HB 813 requires a claimant whether the insured or an injured third party give written notice of their claim. If the insurer makes an offer for an amount within the policy limit within 45 days, the insurer "is not liable for bad faith failure to settle."
