A Michigan man terminated from his job at yard products manufacturer Barrette Outdoor Living, Inc. was hit with a $35,000 spoliation sanction — and an irrefutable adverse inference for trial — for deleting more than 270,000 files from his laptop and dumping his cell phone. But it could have been worse.

On August 1, United States District Judge Julian Abele Cook, Jr. of the Eastern District of Michigan imposed the sanctions on John H. Lemanski Jr., a former Barrette purchasing manager who was fired in June, 2011, in Barrette Outdoor Living, Inc., Plaintiff, v. Michigan Resin Representatives, L.L.C.; John H. Lemanski Jr.; Lisa J. Wells; and Tamara L. Turner, defendants. United States District Court, E.D. Michigan, Southern Division.
