A proposal the top Republican and ranking Democrat on the House Intelligence Committee released Tuesday to limit the National Security Agency’s access to telephone and Internet companies’ customer information has raised red flags at civil liberties groups, with one organization saying the bill has a “fatal flaw.”
The FISA Transparency and Modernization Act [PDF] from Reps. Mike Rogers, R-Mich., and C.A. “Dutch” Ruppersberger, D-Md., would stop the NSA’s bulk collection of user data, forcing the agency to engage telephone and Internet companies each time it seeks information for a customer. The American Civil Liberties Union and the Center for Democracy & Technology said they support the end of bulk data gathering, but are troubled that the legislation would allow U.S. authorities to get customer information without prior court approval.
