PepsiCo’s claims of fraud against a Pennsylvania company—brought after discovery got under way in a $9 million breach of contract case the company had initially filed against PepsiCo—have survived a motion to dismiss in federal court.
Power Restoration International, a Broomall, Pa.-based company that designs and installs industrial electrical systems, first brought a suit against PepsiCo in 2012, alleging that the multinational company had prematurely cut its contract to redesign the electrical usage at several plants. U.S. District Judge Gene E.K. Pratter of the Eastern District of Pennsylvania let stand two of Power Restoration’s claims last October.
