A federal judge has dismissed ex-Penn State University President Graham Spanier’s suit seeking to have the prosecution against him dropped.
On Friday, U.S. District Judge Yvette Kane of the Middle District of Pennsylvania granted state Attorney General Kathleen Kane’s motion to dismiss in Spanier v. Kane. Spanier’s suit had alleged that the investigation underlying the criminal case against him was conducted in bad faith, and that it violated his constitutional right to due process. The suit sought a federal injunction that would stop the state-level prosecution Spanier faces in connection with an alleged cover-up of sex abuse committed by Jerry Sandusky.
