A California federal judge’s copyright ruling against satellite radio company Sirius XM Holdings Inc. has sent shockwaves through the copyright bar.

In a summary judgment order on Sept. 22, U.S. District Judge Philip Gutierrez ruled that Sirius faces California copyright liability for broadcasting or streaming songs predating the federal copyright law’s 1972 protection date. The Central District of California judge categorized such actions as an unauthorized public performance.
