One co-anchor’s role in getting the other fired over a racial slur ties their employer, Fox 29, closely enough to the resulting lawsuit that the case has withstood summary judgment twice.

U.S. District Judge R. Barclay Surrick of the Eastern District of Pennsylvania first denied summary judgment to the Philadelphia Fox network affiliate in 2010 and again last week after the station had asked him to reconsider the motion in light of an intervening decision from the U.S. Supreme Court.
