Relying on a U.S. Supreme Court decision over the burden of proof for mandatory sentencing guidelines, the state Superior Court on Tuesday struck down the drug-free school zone sentencing scheme as unconstitutional.
The ruling is the latest in a string of decisions by the Superior Court since August that have struck down mandatory minimum sentencing laws as unconstitutional.
