Waging legal battle against Uncle Sam is always difficult, but could become more so if the U.S. Supreme Court agrees with arguments the Obama administration offered on Wednesday that certain tort claims against the government are barred forever.
The justices appeared divided as they heard back-to-back arguments in two cases involving filing deadlines for lawsuits and administrative claims under the Federal Tort Claims Act (FTCA). The law, enacted in 1946, provides a limited waiver of the government’s sovereign immunity for some tort claims by private parties.
