SAN FRANCISCO — Federal Circuit Judge Kimberly Moore called on her colleagues Monday to reconsider case law that permits the U.S. Patent and Trademark Office to withhold trademarks that are “immoral,” “scandalous” or “disparaging.”

Her opinion—styled as “additional views” accompanying her majority opinion in In re Tam—appears to be a shot in the ongoing legal battle over the Washington Redskins’ controversial trademark, currently playing out in Virginia.
