The litigation began with MMB Properties, a cardiology practice, trying to use a deed restriction to limit the activities of its neighbor, a new Planned Parenthood facility in Kissimmee. It has morphed into a debate over how flexible trial judges should be when it comes to reviewing their own rulings.
