Are students who help with teaching and research at private universities employees or just plain old students? That’s the thorny question the National Labor Relations Board is trying to resolve, and amici had a lot to say on the issue this week.

The full board is considering a bid by Columbia University students looking to organize. A flurry of amicus briefs filed last week by unions, universities and academics highlights key issues in the case, such as the definition of “employee” under the National Labor Relations Act and the possible impact of collective bargaining on higher education.
