The Federal Trade Commission (FTC) has a new tool for developers of health-related mobile apps, which could lead to increased efforts to ensure compliance. The web-based tool provides assistance to the developers when figuring out what regulations and laws apply to the apps.

The tool was needed given current trends, said Randal Shaheen, a partner in Venable’s regulatory and advertising and marketing practice groups. “Health-related mobile apps are becoming increasingly popular but are potentially subject to a complex set of federal and state laws and regulations, including HIPAA, privacy laws, truth in advertising, the Federal Food, Drug, and Cosmetic Act,” Shaheen explained. “The FTC is attempting to educate developers of these apps about the various laws and regulations that they must comply with and so avoid problems down the road that could impact consumers such as data breaches.”
