Navigating the issue of marijuana and the workplace can be a little, well, hazy at times. “With laws respecting the use of marijuana for either medical or recreational purposes constantly cropping up, employers should be aware of their respective rights and obligations,” Cary Burke of Polsinelli writes in a recent blog post. Here are some of his pointers to employers:

Hiring and firing: Since marijuana is still illegal under federal law, employers can terminate an employee who violates a workplace policy by using, selling or possessing it at work. But in states that have legalized medical marijuana, employees can’t be fired for testing positive for marijuana metabolites if he or she possesses a valid medical marijuana card.
