Standard form liability insurance policies typically include a duty to defend or to advance defense costs when a policyholder faces a potentially covered claim by a third party. Some courts call this “litigation insurance.” However, many policyholders are surprised to discover later that certain costs will not be covered and, in some instances, their insurers claim that the costs advanced must be paid back.
