A $20 million medical device verdict that made new law on directors’ fiduciary duty appeared to be on shaky ground Tuesday at the U.S. Court of Appeals for the Federal Circuit.
Two judges strongly hinted that U.S. District Judge Yvonne Gonzalez Rogers of Oakland overstepped her jurisdiction by adding state law breach-of-fiduciary claims to a patent infringement suit between competing San Francisco Bay Area companies.
