That’s the position in which Carlos Moreno, confirmed last month as the newest justice on the Supreme Court, finds himself this week.

When Moreno attends his first oral arguments, which begin today in Sacramento, one of the 13 cases on the calendar is Marks v. Superior Court, S085224. Already argued once on June 6, the case — which deals with the powers of habeas corpus counsel in death penalty appeals — is the only one being reargued after the June death of former Justice Stanley Mosk.
