Democrats plan to question Supreme Court nominee John Roberts about a disavowed Justice Department memo from 2002 that critics say led to torture in foreign prisons, top Senate Judiciary Democrat Patrick Leahy said Monday. Leahy gave Roberts a copy of the so-called "Bybee memo" at a meeting Monday so he would be prepared for questions at his confirmation hearings, which start Sept. 6. "I don't think a Supreme Court hearing is a game of gotcha," Leahy said. "I'd really like to know what he thinks."
