A U.S. Army veteran who alleges he developed silicosis from exposure to silica dust while working in a quarry for the Army has filed a breach of fiduciary duty and fraud civil suit in state court in Houston against lawyers who formerly represented him in an unsuccessful silicosis products liability case.
Clark Kirkland, who lives in South Carolina, alleges in his Sept. 7 original petition that Houston attorney Mike Martin, a partner in Maloney, Martin & Mitchell, and Scott G. Monge, of Monge & Associates in Dunwoody, Ga., mishandled his silicosis suit. In Clark Kirkland v. Mike Martin, et al., which was filed in 152nd District Judge Kenneth Wise’s court in Houston, Kirkland also names the firm of Maloney, Martin & Mitchell as a defendant.
