While policy adjustments made by the U.S. Department of Justice in regard to corporate investigations were thought to be much-needed by the white-collar defense bar, some Pennsylvania practitioners are questioning whether those changes will have any real effect.
After pressure from judges, Congress and the corporate world, the Justice Department announced this week a series of policy changes that aim to stop prosecutors from using a corporation’s refusal to share certain information as a check against the company when it comes time to decide whether to prosecute.
