In the first case of its kind in New Jersey, the AppellateDivision has ruled that mid marriage agreements are valid onlyif, after close scrutiny, they are fair at the time of executionas well as at the time of enforcement.

A three judge panel reversed the trial court’s finding thata 1986 mid marriage agreement between Antonio and FrancescaPacelli was enforceable.
