In the first decision of its kind in the Second Circuit, a panel has ruled that a defendant’s consent to deportation can be grounds for lighter punishment under the federal sentencing guidelines.
The U.S. Court of Appeals for the Second Circuit said that such a stipulation by a defendant could be a mitigating circumstance when it spares the government a lengthy deportation process.
