The legal fight between members of the seminal punk band Dead Kennedys is sad, ironic, cynical and even hypocritical.

But it’s not a federal issue. So ruled Senior District Judge D. Lowell Jensen in remanding Dead Kennedys v. Jello Biafra, 98-4543, back to San Francisco Superior Court. In doing so, Jensen also ordered defendant Biafra to pay plaintiffs attorneys from Phillips & Erlewine $12,160.50 in fees and costs for wasting their time trying to get a federal court to resolve a fight that, according to Jensen, is a simple contract dispute covered by state law.
