A federal appeals court yesterday vacated the award of $52 million to a pair of “whistleblowers” whose fraud suit on behalf of the United States against SmithKline Beecham Clinical Laboratories Inc. was settled for $325 million.

The unanimous three-judge panel found that the lower court improperly barred Justice Department lawyers from arguing that the whistleblowers were not the “original sources” of the information.
