An employee who was not responsible for obtaining the necessary permits for dumping tires could not be held criminally responsible for the failure to get such permits, the Pennsylvania Commonwealth Court has held.
In rejecting the commonwealth’s claim that Section 601(1) of the Solid Waste Management Act should apply to “any person,” Judge Rochelle Friedman said “such an interpretation would lead to unreasonable and absurd results.”
