The impact an injury has on the plaintiff is a factor in determining whether the plaintiff suffered a serious injury in limited tort cases, the Pennsylvania Superior Court has ruled in an apparent case of first impression.
For instance, the court said, while a broken pinky wouldn’t be considered a serious injury for most, it might qualify as one for a concert violinist.
