A Nassau County judge has dismissed a whistleblower lawsuit filed by a nurse who alleged she was fired by North Shore University Hospital at Plainview in New York after she complained about unsanitary surgical procedures that were allegedly practiced at the hospital.
Virginia Phyllis Berde was a nurse manager in the hospital’s perioperative unit when she was fired in July 2004 after 32 years of service. She later filed a lawsuit against the hospital under the so-called “whistleblower statute” embodied in ��740 and 741 of New York state Labor Law.
