Eli Lilly and Co. says it will settle about 18,000 lawsuits alleging the drugmaker did not adequately warn patients that its anti-psychotic medication Zyprexa carries a heightened risk of diabetes. A Lilly spokeswoman said the claims were less viable than 8,000 cases the company settled for about $700 million in 2005, due to a Zyprexa labeling change addressing diabetes risks. She said Lilly will go to trial to resolve 1,200 remaining cases, which she said are not being settled for "various reasons."

Eli Lilly and Co. has said it will settle about 18,000 additional lawsuits alleging the drugmaker did not adequately warn patients that its anti-psychotic medication Zyprexa carries a heightened risk of diabetes.
Lilly did not disclose the amount of the settlement but said in a statement it would take a fourth-quarter settlement charge that’s not expected to exceed $500 million.
