On Thursday, Northern District of Texas Judge Sidney Fitzwater of Dallas dismissed a case in which a jury had found that a former Baron & Budd associate had breached his fiduciary duty to three clients by deliberately lying to them about their asbestos case.

Fitzwater granted the defendants’ motion for judgment as a matter of law and dismissed the case against Ken Tapscott with prejudice, ruling that there was not sufficient evidence to support the jury’s decision in Karin Jacobs, et al. v. William K. Tapscott Jr., et al.
