Philadelphia Common Pleas Judge Mark I. Bernstein has said that the $4.1 million in plaintiffs’ attorney fees he awarded in a Kia Motors faulty brake class action were warranted.

Bernstein also dismissed the chief defense witness used to challenge the plaintiffs’ attorney fees as dishonest. Bernstein was required by a Pennsylvania Superior Court October memorandum opinion to issue a supplemental 1925(a) opinion to support why he awarded $4.125 million in counsel fees and $267,513 in expenses in January 2006.
