On March 19, 1998, the Acting Regional Director forRegion 1 issued a Decision and Direction of Election inthe above-entitled proceeding, in which the Petitionerseeks to represent a unit of all registered nurses (RNs)employed by the Employer at its 344-bed nursing home.The Employer objected to the inclusion in the unit ofRNs who work as charge nurses, asserting that they aresupervisors within the meaning of Section 2(11) of theAct as they evaluate and discipline the Employer’s certifiednursing assistants (CNAs), assign and direct theirwork, and adjust their grievances. The Acting RegionalDirector found that the RN charge nurses are statutorysupervisors solely on the basis of their authority to per-formprobationary evaluations of newly hired CNAs andtheir role in the annual merit raise evaluations of allCNAs.
